Title Stiff punishment for software copyright infringement

Stricter enforcement against software copyright infringement is to take effect. The personal reproduction of s/w is now considered to be illegal and the personal accusation provision is to be excluded when cracking down on the illegal mass reproduction of s/w for commercial purpose.
According to the announcement made by related organizations and industry on June 7, the government has prepared the revision of Computer Program Protection Act with the above changes and plans to make notification of the proposed rulemaking as early as next week. After collecting opinions and completing the examination by Ministry of Legislation, the revised bill will be submitted to the congress.
In this revision, regulation for s/w copyright infringement has been reinforced. To balance the severity of penalty with related legislations, the existing penalty of ‘fine not exceeding 50 million KRW or imprisonment not exceeding 3 years’ will be strengthened to punishment of ‘fine not exceeding 70 million KRW or imprisonment not exceeding 5 years.’ Furthermore, the penalty for repeated offenders will be increased to ‘fine not exceeding 70 million KRW or imprisonment not exceeding 7 years.’
So far, the illegal reproduction of s/w for personal use has been excluded from the regulation and control. The revision, however, sets out to include personal reproduction committed knowingly of its illegality to be illegal. Therefore, reproduction of illegal reproductions or reproduction through internet or P2P will be the subject of regulation.
Finally, although personal accusation provision has been applied for illegal reproduction of s/w restricting the law enforcement, it will be lifted in case of illegal reproduction of s/w for commercial purposes making it possible to punish the offense without mutual consent.
